Kate W. Feola is an associate in the Health Law Department of McDermott Will & Emery LLP based in the Firm’s Washington, D.C. office. 

Prior to joining McDermott, Kate was an associate in a large international law firm in Washington, D.C.  There, Kate advised pharmaceutical and medical device manufacturers on federal and state regulatory and compliance matters.  In this regard, Kate advised pharmaceutical clients on state marketing and gift disclosure laws, reviewed various pharmaceutical sales and marketing programs and performed weekly reviews of a pharmaceutical client’s promotional review committee materials for fraud and abuse issues.  

In addition to advising pharmaceutical and medical device manufacturers, Kate has experience advising hospital clients on regulatory and compliance matters involving Medicare and Medicaid fraud and abuse and has assisted with internal compliance reviews, audits and responses to civil and criminal investigations conducted by federal and state government agencies. 

Prior to her legal career, Kate worked in various management positions in the health care industry.  She was the Administrator of the Georgetown University Hospital Department of Emergency Medicine.  In this position Kate was responsible for a $2 million budget and was responsible for departmental operations and compliance matters, such as billing, coding and collection, the Emergency Medical Treatment and Active Labor Act (EMTALA) and relevant Joint Commission on Accreditation of Health Care Organizations (JCAHO) requirements.  In addition to hospital administration, Kate has managed both primary care and multidisciplinary physician practices and has experience with practice startup and physician recruitment.  Kate also worked as a Provider Relations Representative for Aetna where she was an advocate for both primary and specialty care provider offices participating in the Aetna insurance network.

Kate has authored various health care articles including Bad Habits: The Qui Tam Provisions of the False Claims Act Are Unconstitutional Under Article II which was featured in the Journal of Contemporary Health Law & Policy in 2002. 

She is a member of the Marymount University, School of Business Administration, Health Care Advisory Committee, which reviews and addresses issues related to the University’s Health Care Management Masters Program, including curriculum, faculty and program accreditation.

Kate is admitted to practice in the District of Columbia and Virginia.
