Elizabeth Mills was quoted in an August 24 article published by BNA’s Health Care Daily regarding the Internal Revenue Service making a compliance check questionnaire available on their website. They will use it to check whether tax-exempt charities that finance capital expenditures through exempt bonds are in compliance with the bond rules. "I don't think the questions are any surprise. It certainly serves as a good guide for what the IRS hopes you will have in place,” Ms. Mills said.

"The questionnaire is important to organizations that don’t receive it, as well as those that do. Elizabeth Mills was mentioned in the June 1 issue of BNA's Health Care Daily in an article titled, "IRS Will Begin Hospital Audits in August; Bond Issuers to Have More Time to Settle." Ms. Mills was quoted saying, "Hospitals should look at whether they can trace the bond proceeds from when they were borrowed to what they were expended on, and what has happened to what they were expended on." The article states that beginning this August, the IRS will notify the issuers of about two dozen qualified Section 501 (c) (3) bonds that their bond issues are under audit.

She clarified "that exempt organizations can participate in joint ventures such as partnerships or limited liability companies with for-profit partners as long as they are an insubstantial part of their activities."

"A not-for-profit might offer key executives the right, at some future date, to pay $25,000 for mutual funds worth $100,000 on the date the option is gained," commented Ms. Mills. "Granting such discounted options has become ubiquitous among not-for-profits," she continued.

Elizabeth Mills was quoted in the July 8 issue of Modern Health Care in regard to a recent U.S. Tax Court decision on the IRS's "intermediate sanctions." Ms. Mills commented that the decision, "…shows the that the tax court will be tough, but fair, on intermediate sanctions cases."
