Two recent Federal Circuit Court of Appeals decisions have changed the rules for life science and pharmaceutical companies seeking DNA sequence patents. The American Civil Liberties Union (ACLU) also filed litigation aimed at declaring certain gene patents unconstitutional. The Federal Circuit’s Kubin and Gleave decisions, the ACLU litigation, and other developments in the patent law will likely transform the competitive landscape for biological drugs that involve patenting DNA and other molecules isolated from nature.
