Employment Alert No. 108: Use of New ET1 and ET3 Forms - Compulsory

From 1 October 2005, it will become compulsory to use the new ET1 and ET3 forms when filing a claim or defence with the Employment Tribunal.

From 1 October 2005, the Tribunal will accept:

  • the official forms;
  • separate attached sheets (e.g setting out the grounds of resistance);
  • .pdf versions of the official forms;
  • faxed versions of the official forms; and
  • black and white photocopies of the official forms.

However, the Tribunal will not accept:

  • the old forms; and
  • any in-house or commercial versions of the new forms which are not the official forms (these are apparently not compatible with the new Tribunal case management system).


Therefore, from Saturday, all ET1s and ET3s must be filed on the official forms or they will be rejected by the Tribunal.  The official forms can be obtained from  http://www.employmenttribunals.gov.uk.
