McDermott Will & Emery’s Energy and Derivatives Markets (EDM) Practice Group regularly represents clients in investigations conducted by the Commodity Futures Trading Commission (CFTC), the Federal Energy Regulatory Commission (FERC), the Federal Trade Commission (FTC), Congressional investigative subcommittees, and self-regulatory organizations. Many members of the EDM Practice Group worked for these agencies prior to joining McDermott. Their knowledge and experience as former government attorneys enables them to provide clients with informed advice about the investigative process and the substantive provisions of the applicable statutes and regulations. Our representation includes advising clients about cooperating with regulatory investigations, negotiating the timing and scope of agency requests, producing responsive documents and information, and representing company officers and employees during interviews and/or investigative testimony. The EDM Practice Group works closely with the Firm’s white-collar criminal defense practice when the criminal authorities are involved in energy and commodity enforcement investigations. We have assisted many clients in avoiding prosecution through the Wells process or resolving matters through settlement.
Our enforcement defense team is comprised of more than a dozen lawyers and includes an energy and derivative markets analyst who was an investigator for the CFTC and the Securities and Exchange Commission (SEC) for more than 20 years.
