- Counsel to trustees on of environmental issues arising out of the holding, management and liquidation of trust property. These matters include environmental cleanup issues caused by the conduct of businesses prior to becoming trust property, and environmental compliance issues arising out of the ongoing management of businesses owned in trust.
- Drafting an environmental policy manual (including forms) for one of the largest bank trust departments in Chicago. The manual created and formalized their procedures for identifying, minimizing and eliminating environmental risks presented by existing and new business, and provided a balance between precautionary procedures and operational flexibility.
- Defending a large trust funded with the proceeds from the sale of the assets of an industrial company against an $100 million environmental claim by the purchaser of the assets.
- Representing a bank trustee that the U.S. EPA is attempting to hold personally liable for trust property cleanup costs which exceed the value of the trust.
- Representing a bank trustee and large trust that was funded, in part, with the proceeds of the sale of a business that owned and operated landfills which are the subject of a government mandated cleanup.
- Assisting banks acting as trustees for employee benefit plans to establish mechanisms to avoid or minimize the risk of incurring liability, as a trustee or in their individual capacity, by virtue of their being an owner or operator of properties with environmental contamination problems.
