Our Antitrust and Competition Group has helped alcohol beverage companies successfully execute large, complex mergers; counseled many alcohol beverage clients in the areas of antitrust and competition; responded to government investigations in the United States and Europe; and litigated cases involving antitrust claims.  Our Firm is experienced in all facets of antitrust and competition law, including antitrust litigation, merger and acquisition analysis and defense, antitrust counseling and consumer protection.  We represent plaintiffs and defendants in civil antitrust litigation in U.S. federal and state courts, and frequently represent parties before the Federal Trade Commission (FTC), the U.S. Department of Justice (DOJ), the European Commission, the Budeskartellamt in Germany, the Autorità in Italy and the Office of Fair Trading and the Competition Commission in the United Kingdom..  Many of our lawyers previously served in government enforcement bodies, as well as Attorneys General offices, providing the Firm with critical insight into the internal workings of the FTC, the DOJ and the National Association of Attorneys General (NAAG).

Representative Antitrust and Trade Regulation Experience in the Alcohol Area

  • Successfully represent a large global drinks company in the FTC’s review of its acquisition of a major competitor, creating one of the world’s largest alcohol beverage businesses.
  • Successfully represent several large spirits companies in federal court litigation alleging violations of the Sherman Antitrust Act, and secure a Rule 12(b)(6) dismissal of all antitrust and other federal claims against our clients, removing them from the case.
  • Advise a major wine supplier in the UK Competition Commission’s investigation of the groceries sector, responding to information requests and making submissions to the Commission.
  • Counsel several alcohol beverage companies in HSR filings and other government defense of antitrust reviews of their merger and acquisition activities.
  • Advise a national U.S. trade association on the competition aspects of its programs and activities.
