Our Intellectual Property, Media & Technology Department includes lawyers who have the experience necessary to counsel clients in a wide variety of fields and industries regarding their advertising and marketing practices. Our lawyers are knowledgeable of the intricacies behind the particular federal and state statutes and regulations to abide by when marketing, labeling, promoting and advertising all products and services, from consumer products to healthcare. Additionally, our lawyers understand the importance of contract review and negotiations within the advertising and entertainment industry.
In order to assist clients in their compliance with federal and state laws and regulations, our lawyers review copy proposed for advertising, labeling, sweepstakes, contests and other types of promotions. This review can help avoid future litigation or investigation, which may be initiated by the U.S. Federal Trade Commission (FTC), competitors or consumers. We represent clients with NAD and network concerns, challenging and defending television, radio, online and print advertising. Our broad experience includes defending advertising and promotions before the FTC and state and local agencies, including consumer protection agencies, sometimes in concert with lawyers from the Firm’s regulatory practice groups such as our Federal Drug and Agriculture and Trade Regulation Groups. We also assist clients in structuring, clearing and registering sweepstakes, contests and similar promotions.
For more than 25 years, the Intellectual Property, Media & Technology Department has handled entertainment industry lawsuits in the areas of copyright, trademarks, breach of contract and unfair competition. Current clients include content providers from the music, television, radio, motion picture and online fields, such as major motion picture studios, major television broadcasters, radio stations, online portals, and record labels; and theaters; national sports associations; galleries and auction houses.
Many of lawyers litigate claims arising from, advertising and marketing practices, including claims for false advertising or misrepresentation of affiliation, endorsement or sponsorship, claims for violations of the rights of privacy and publicity, and trademark and copyright infringement claims.
