Employee benefits lawyers in our Insurance Industry Group have decades of experience representing insurance companies. We regularly represent insurers as employers providing employee benefit plans for their employees; and we also represent insurers in providing insurance products and third-party administration services to employee benefit plans of other employers. We advise insurance companies on the design and implementation of sophisticated and innovative retirement plans, executive compensation plans, health and welfare benefit plans, and other arrangements. Our lawyers advise clients on the complex requirements of federal and state laws, such as the Internal Revenue Code, ERISA, HIPAA, and COBRA, as well as the unique problems faced by ERISA fiduciaries when they manage the investment of plan assets. Our understanding of the issues affecting the insurance industry, also enables us to provide our clients with practical advice on how their products and services will be received in the marketplace.
EMPLOYEE BENEFITS LITIGATION ~ Our Insurance Industry Group includes lawyers with experience in a wide variety of litigation involving administration of employee benefit plans and defense of plan sponsors, plan trustees, and fiduciaries, including insurance companies. We represent insurance companies, plan sponsors, plan administrators, banks and other plan trustees in both routine and complex ERISA and ESOP litigation matters. We represent benefit plan fiduciaries in all types of disputes with plan participants, the Department of Labor and the IRS, including disputes covered by ERISA fiduciary insurance policies. In addition to litigating ERISA matters in federal courts throughout the country, we counsel companies in anticipation of litigation about employee benefit issues. We are also experienced in the defense of insurance companies in benefit claims litigation by their own employees and agents, as well as by employees of insured companies.
