Overview
Caroline Incledon focuses her practice on litigating complex commercial disputes before state and federal courts, focusing principally on representing clients in the financial services and healthcare industries. Among other areas of law, Caroline has handled disputes involving breach of contract, ERISA, securities fraud, antitrust, and civil RICO claims. Caroline also maintains an active pro bono practice, representing pro bono clients in family law matters.
While in law school, Caroline was on the editorial board of the American Criminal Law Review and authored a note selected for publication.
Results
- Representing a leading health insurer in several matters alleging ERISA, antitrust, RICO, and state law violations based on the health insurer’s payment practices
- Won dismissal of class action complaint against health insurer by out-of-network providers alleging RICO, antitrust, and various state law claims
- Won dismissal with prejudice of complaint against an online review platform filed by a putative nationwide class, alleging breach of contract and deceptive business practices
- Obtained favorable ruling on class certification in purported class action against financial institution alleging antitrust violations*
- Obtained affirmance of dismissal of securities fraud claims brought by a purported class of shareholders regarding the effectiveness of financial institutions’ internal controls*
