Daniel (Dan) Graham leads the Firm’s Government Contracts Group. Highly regarded in government contracts litigation, Dan has more than two decades of experience assisting clients across industry sectors on bid protests, Contract Disputes Act appeals, prime and subcontractor disputes, and commercial litigation.

Bid Protests

  • Successfully represented one of the largest test and evaluation services contractors in the US in successive GAO protests and civil claims involving the US Army’s award of a $693 million contract for test support services at the Army’s Aberdeen Test Center. In 2023, Dan’s team successfully protested the Army’s award of this contract to a competitor, resulting in a GAO decision sustaining the protest on multiple grounds. The client received the award as a result of the Army’s corrective action, and Dan’s team successfully defended that award in a protest filed by the prior awardee
  • Successfully represented a large personal protective equipment supplier in successive protests at GAO and the COFC regarding the US Department of Health and Human Services’ (HHS) procurement of isolation gowns for the strategic national stockpile. Dan’s team successfully challenged an initial award to a competitor, and then an adverse competitive range determination, after which the client was able to secure an award
  • Represented a large Medicare Advantage plan in connection with multiple procurements for the provision of Medicare Advantage plans, Part D prescription drug plans, and “MAPD” plans (which combine Medicare Advantage and Part D coverage) to various state entities, including the successful defense of a state-level bid protest challenging one award to the client
