Overview
Benjamin counsels private equity firms, portfolio companies, physician practices, and management services organizations on healthcare regulatory frameworks governing facility licensure and accreditation, clinical laboratory registration, corporate practice of healthcare professions, and changes of ownership and control over healthcare entities navigating physician practice management transactions.
Benjamin also focuses his practice on compliance with the Health Insurance Portability and Accountability Act (HIPAA), in particular in mergers and acquisitions including covered entities under HIPAA. Related to this work, Benjamin ensures client compliance with the Telephone Consumer Protection Act (TCPA) and the CAN-SPAM Act. He has also assisted on matters relating to unauthorized uses or disclosures of protected health information (PHI), security incidents, and data breaches.
Benjamin works with clients to file Medicare appeals addressing medical necessity and coverage for novel procedures, to develop reimbursement coding and billing strategies with government payors, and to form managed care arrangements with commercial payors. Benjamin’s pro bono work has focused on compliance with Medicaid provider requirements across the country. He has also worked on Federal False Claims Act (FCA) civil investigations and similar state-level investigations.
While in law school, Benjamin served as a summer associate at a clinical genetic testing and diagnostics company. He also was senior articles editor for the NYU Journal of Law and Liberty. Prior to attending law school, Benjamin was a biostatistics and computational biology researcher for a cancer treatment and research institution.
