Overview
Mandy H. Kim is a high-performing and zealous patent trial lawyer and litigator. She has extensive experience in managing complex, bet-the-company litigations across a wide range of technologies, including in the life sciences, biotechnology, medical devices, computer hardware and software, and consumer electronics industries. Mandy has led teams in all stages of litigation from pre-suit investigations through trial and appeals. She has an impressive record in achieving favorable results for her clients in district courts, the Patent Trial and Appeal Board and the International Trade Commission.
In addition to her practice, Mandy is a leader in her community as a member of the board of directors for Public Law Center and executive board for Orange County Korean American Bar Association. She is actively advancing the Firm’s commitment to diversity and inclusion and pro bono, serving on the Firm’s Racial and Ethnic Diversity Committee and as the head of pro bono and hiring partner for the Orange County office.
Prior to practicing law, Mandy was a research associate in molecular, cell and developmental biology and microbiology, immunology and molecular genetics laboratories. She has authored a number of publications in connection with her research, and also worked as a technology transfer specialist in the Office of Intellectual Property at UCLA.
Results
- Successfully obtained a jury trial win in favor of Natera Inc. in a patent infringement case involving novel methods of preparing DNA/RNA. (Natera, Inc. v. ArcherDX, Inc. et al.)
- Secured a trial win in favor of United Therapeutics Corporation on a patent relating to methods of treating pulmonary hypertension in which the US District Court for the District of Delaware found United Therapeutics’ patent infringed and valid. (United Therapeutics Corp. v. Liquidia Techs., Inc.)
- Obtained a favorable settlement on behalf of Aurinia Pharmaceuticals in a patent litigation involving novel pharmaceutical drugs for dry eye disease. (Aurinia Pharmaceuticals Inc. v. Sun Pharmaceutical Industries, Inc. et al.)
- Successfully obtained a favorable jury verdict in favor of Amgen in a patent infringement case involving novel antibody therapeutics for the treatment of high cholesterol. (Amgen Inc. v. Sanofi et al.)
- Obtained favorable settlement on behalf of Ambry Genetics in a patent infringement case involving patents claiming human DNA sequences following a favorable Federal Circuit decision that disposed of a number of claims at issue, (In Re BRCA1- and BRCA2-Based Hereditary Cancer Test Patent Litigation)
- Secured an initial determination of no infringement, invalidity and no domestic industry in favor of Panasonic before the International Trade Commission. (In the Matter of Certain Digital Media Devices, Including Televisions, Blu-Ray Disc Players, Home Theater Systems, Tablets and Mobile Phones, Components Thereof and Associated Software)
- Obtained global settlement on behalf of HTC in a patent infringement action before the International Trade Commission. (In re Certain Electronic Devices, Including Mobile Phones and Tablet Computers and Components Thereof)
- Secured a favorable settlement after a bench trial on behalf of Tolmar in a patent infringement action involving patents relating to treatment of psoriasis. (LEO Pharma, A/S v. Tolmar, Inc.)
- Obtained favorable settlement on the eve of trial on behalf of Sandoz in several patent litigations brought under the Hatch-Waxman Act. (Cephalon, Inc. and Cima Labs, Inc. v. Sandoz, Inc.; Warner Chilcott Company, LLC, et al. v. Sandoz, Inc.)
