Overview
Mark A. Bilut counsels clients on all aspects of environmental law, environmental due diligence and strategy in corporate transactions and financings, and toxic tort litigation.
Mark has significant experience defending manufacturing clients in class actions and multi-party actions in connection with contamination and other alleged hazardous exposures (e.g., asbestos and welding fume exposure), and in advising clients on environmental compliance obligations and administrative enforcement proceedings arising under all major federal and state environmental laws, including the following:
- The Clean Air Act (CAA)
- The Clean Water Act (CWA)
- The Compensation and Liability Act (CERCLA)
- The Comprehensive Environmental Response
- The Emergency Planning and Community Right-to-Know Act
- The Hazardous Material Transportation Act
- The Occupational Safety and Health Act (OSHA)
- The Resource Conservation Recovery Act (RCRA)
In addition, Mark has done considerable work on Native American environmental issues.
Results
- Represents defendants in class actions and multi-party actions in Illinois, Michigan and Mississippi involving alleged exposures to hazardous substances from contaminated soil, groundwater and air releases
- Advises and represents industrial companies on environmental and OSHA compliance matters and in enforcement proceedings before federal and state agencies
- Represents an industrial company in a civil and criminal investigation undertaken by Department of Justice and US Environmental Protection Agency (EPA) alleging violations and falsifications under the CWA, CAA, RCRA, Safe Drinking Water Act (SDWA) and Emergency Planning and Community Right-to-Know Act (EPCRA)
- Negotiates orders and work plans with federal and state agencies under the major federal and state environmental laws in connection with enforcement proceedings and in connection with CERCLA removal and remedial actions and RCRA investigations and remediation
- Represents owners, operators and generators in federal and state Superfund proceedings, RCRA corrective action matters and in cleanups performed pursuant to state voluntary cleanup programs
