Overview
Anita Franklin focuses her practice on complex and multi-jurisdictional disputes in private wealth litigation matters, commercial matters and international arbitration. She has represented clients in breach of trust, negligence, fraud, money-laundering, forfeiture, accounting disputes, regulatory investigations and estate and probate matters.
Anita has strong trial experience advising international private clients, institutional clients and corporations across multiple jurisdictions including the UK, the US the Middle East, Latin America and offshore jurisdictions.
Results
- Represented an ultra-high-net-worth family in substantial proceedings for breach of trust in the Bahamas between the beneficiaries and trustees in a long-running and high value family dispute.
- Represented beneficiaries of certain offshore trusts in respect of Subject Access Requests under the DPA and securing a victorious and landmark judgment in the Court of Appeal for beneficiaries seeking information from data controllers in the age of transparency.
- Represented a beneficiary of a BVI trust and successfully defending against an attack on the structure of the trust by reason of foreign matrimonial property rights. This was the first case to test the effectiveness of the BVI firewall legislation and its ability to repel claims arising from a foreign community property regime.
- Represented securing orders for interim and injunctive relief as well as a custodial sentence for a beneficiary of an offshore trust against the trust’s Protector and Trustee under committal proceedings.
- Represented a public audit firm and their professionals in an international arbitration arising from matters of audit and advisory work connected with allegations of breach of Generally Accepted Accounting Principles and Generally Accepted Auditing Standards.
- Represented a health care provider in a breach of warranty dispute under a share purchase agreement with allegations of fraud, dishonesty and deliberate concealments.
- Represented a trustee in Guernsey asset forfeiture proceedings frozen in offshore bank accounts in connection with civil and criminal proceedings in Latin America.
