Mexican Government Challenges Employee Insourcing and Outsourcing Structures

Mexico’s president sent a bill to the Congress of the Union proposing amendments to insourcing and outsourcing structures of several key employment and tax laws. These amendments would cause several commonly used structures to become inoperable and will require staffing and placement agencies to comply with specific regulations and become registered with the Mexican authorities.

This webinar is intended to provide insight into the fluid state of the negotiations between the government and the business community on these issues, as well as to address the relevant impact that these proposals will cause from an employment and tax law perspective.

Companies using these structures should begin to analyze the impact this will have on their business as soon as possible.

During this complimentary webinar, McDermott Will & Emery and GarcíaMingo & Tejedo will provide guidance on how to navigate this new legislative environment. Topics will include:

  • Impact of the legislation on current employer structures, including the use of internal service entities and external service providers
  • Strategies for implementing new employer structures, including contractual rights, employee transfers and litigation considerations
  • Impact on deductibility of payments made to outsourcing companies
  • Exposure to non-creditable value added tax payments
