McDermott Builds on Litigation Practice Momentum with Atlanta Investigations & White-Collar Defense Partner

Overview

International law firm McDermott Will & Emery continues to expand its Litigation Practice Group, welcoming Amy Bentsen (Boring) as a partner in Atlanta. Amy advises clients, primarily in the healthcare space, in white-collar criminal defense matters. She counsels corporations and individuals facing complex civil disputes and provides strategic crisis management and compliance counseling. Amy joins from King & Spalding.

“In recent years, we’ve built one of the strongest healthcare litigation and compliance offerings in the US, serving a range of diverse client needs,” said Steven Scholes, global head of McDermott’s Litigation Practice Group. “Amy’s arrival builds on the strong momentum of our Litigation Practice Group, which this year has welcomed a number of skilled criminal defense practitioners across the US. These additions reflect our commitment to serving a growing demand for high-stakes litigation and enforcement counsel.”

As part of her practice, Amy represents companies and individuals in investigations by federal and state authorities, including the US Department of Justice, multiple US attorneys’ offices, the US Department of Health and Human Services Office of Inspector General, the US Food and Drug Administration (FDA) and the US Drug Enforcement Agency (DEA). Additionally, as a Certified Compliance & Ethics Professional, Amy handles compliance assessments; advises on compliance program design and operation; and develops related policies, procedures and training materials.

Amy’s notable client representations include:

  • Advising a hospital system in a joint investigation by a US attorney’s office and the DEA relating to the handling of controlled substances.
  • Representing a national retail pharmacy chain in multiple False Claims Act and qui tam matters, including allegations of the payment of kickbacks, coordination of benefits issues, submission of incorrect “usual and customary” prices to government payors, and dispensing of expired drugs.
  • Conducting a comprehensive compliance review of a publicly traded, international healthcare technology company to assess the design, adequacy and effectiveness of their compliance program.

“I have long admired McDermott’s skilled litigation and healthcare practices and am eager to join in Atlanta, a market where I have built longstanding client relationships,” Amy said. “I look forward to leveraging McDermott’s global, cross-practice platform to continue delivering best-in-class client service.”

McDermott recently welcomed a seven-lawyer white-collar litigation team from Orrick, including partners Guy Singer, Anne Murray, Franklin Monsour Jr., Kelly Newsome and Caitlin Sheard. In addition, McDermott welcomed Sagar Ravi, the former chief of the Complex Frauds and Cybercrime Unit at the US Attorney’s Office for the Southern District of New York; Matthew “Matt” Madden, the former chief of the Criminal Division at the US Attorney’s Office in Chicago; and James Durkin, a former assistant US attorney in the Northern District of Illinois.
