International law firm McDermott Will & Emery represented CoServ Electric, the largest of the 16 member cooperatives of Brazos Electric Power Cooperative, Inc., the oldest and largest generation and transmission power cooperative in Texas.
Brazos filed for Chapter 11 on March 1, 2021 in the aftermath of Winter Storm Uri, a catastrophic winter storm that blanketed the State of Texas during the week of February 13, 2021. Shortly thereafter, Brazos received invoices totaling over $2 billion from the Electric Reliability Council of Texas (ERCOT) in connection with electrical power Brazos purchased in the ERCOT market during Winter Storm Uri.
After nearly two years, Brazos emerged from Chapter 11 on December 15, 2022. CoServ Electric was an active participant throughout Brazos’ Chapter 11 case and related, contentious litigation, including litigation initiated by Brazos against ERCOT, and litigation initiated by the unsecured creditors committee and Brazos against CoServ Electric. CoServ Electric’s active participation in Brazos’ Chapter 11 case helped achieve several critical goals, which will also benefit the other member cooperatives.
