Overview
David Beach focuses his practice on representing clients in complex employment and labor litigation.
David represents and advises companies navigating union organizing and election campaigns, as well as unfair labor practice investigations and trials. He also has experience litigating individual, collective and class action claims in disputes involving Title VII of the Civil Rights Act of 1964, 42 U.S.C. §1981, the Americans with Disabilities Act (ADA), the Fair Labor Standards Act (FLSA) and related state and local employment and labor laws.
David counsels clients on a wide range of labor and employment issues including strategic planning on unionized operations, personnel policies and practices, and employment contracts.
David maintains an active pro bono practice including representing clients seeking asylum into the US.
Results
- Prevailed at trial, and then on appeal to the US Court of Appeals for the Eleventh Circuit, on behalf of a Fortune 500 company in a landmark case involving claims under Title III of the ADA
- Represented a Fortune 500 company and prevailed at arbitration on claims alleging violations of an inherited Collective Bargaining Agreement
- Represented an international client and achieved complete dismissal of unfair labor practice charge before the National Labor Relations Board (NLRB)
- Prevailed on multiple disability discrimination complaints filed with state administrative agencies
