Overview
Franklin Monsour Jr. is a former federal prosecutor and experienced trial lawyer who focuses his practice on white-collar defense, regulatory enforcement matters and complex commercial litigation.
Franklin represents clients in both criminal and civil government actions, particularly in the healthcare, life sciences and securities industries. His prior experience prosecuting record-setting cases under the False Claims Act (FCA) and the Anti-Kickback Statute (AKS) informs his defense of clients under FCA investigation. Franklin has a successful track-record of convincing the US Department of Justice (DOJ) to resolve investigations without action. His securities practice includes defending clients in criminal and US Securities and Exchange Commission enforcement matters, and securities class actions.
Franklin’s civil litigation experience includes pursuing affirmative cases on clients’ behalf. He has investigated and filed complex civil Racketeer Influenced and Corrupt Organizations Act and civil fraud cases, obtaining injunctive relief and damages. He has extensive experience with asset tracing and civil ex parte seizures, and often coordinates with private investigators and law enforcement agencies.
In his criminal defense practice, Franklin draws on his broad experience as an assistant US attorney for the US Attorney’s Office for the Southern District of Florida. In that role, he prosecuted and tried criminal cases involving fraud, narcotics and violent crimes, and represented the DOJ in large-scale civil enforcement actions. Franklin was lead counsel in negotiating multiple record settlements totaling more than $100 million in FCA, AKS and civil penalty recoveries. His cases included the largest US Drug Enforcement Administration drug diversion recovery under the Controlled Substances Act and the largest criminal fraud compound pharmacy case to go to trial.
Franklin maintains an active pro bono practice. His pro bono highlights include working in collaboration with the National Coalition on Black Civic Participation and the Lawyers’ Committee for Civil Rights to secure a major win for plaintiffs in a voter intimidation case.
