Overview
Rachel Peltzer advises clients on litigation matters, with a particular focus on commercial disputes in both federal and state courts. She has experience in a broad range of litigation matters, including breach of contract and business disputes, trade secret litigations, False Claims Act litigations, antitrust matters, and arbitration proceedings, among others. Rachel also maintains an active pro bono practice, including Federal Tort Claims Act matters.
Prior to rejoining McDermott, Rachel was a law clerk to the Honorable Frank M. Hull of the US Court of Appeals for the Eleventh Circuit. During law school, Rachel was a notes and comments editor for the Emory Law Journal. She was also a student researcher for the Barton Appeals for Youth Clinic as well as the Emory Law International Humanitarian Law Clinic where she worked with the Office of Global Criminal Justice at the US Department of State focusing on genocide, crimes against humanity, and war crimes.
Results
- Obtained award terminating a $240 million loss portfolio transfer reinsurance agreement due to the cedent’s fraudulent misrepresentations.
- Obtained summary judgment of an ERISA lawsuit alleging breach of fiduciary duties and claiming over 100 million dollars in damages.
- Represented vendor of electronic health record systems in contract dispute involving licensing of de-identified electronic health records data and health insurance claims data (Real World Data). Won jury verdict for breach of contract following three-week trial and prevailed in post-trial injunction proceeding.
- Assisted alcohol beverage client in various contract disputes.
- Secured dismissal of an antitrust lawsuit alleging monopolization and restraint of trade with respect to the sale of electrophysiology catheters on behalf of a medical devices company. *
