Overview
Rode Carpio focuses her practice on complex commercial litigation matters. Rode has experience representing plan sponsors, plan trustees and fiduciaries, and employee benefits services providers in disputes related to employee benefits issues, including ERISA class action matters. She frequently assists with coordinating discovery and researching and drafting motions, briefs, pleadings and memoranda.
Rode has also helped to guide clients through governmental investigations brought by the Department of Labor (DOL) related to various employee benefits plans.
Rode previously served as a law clerk at the US Court of Appeals for the Eleventh Circuit for the Honorable Adalberto Jordan. While in law school, she served on the editorial board for the University of Miami Business Law Review.

- Representing an ESOP trustee in an ERISA class action matter involving claims of alleged prohibited transactions and breach of fiduciary duty
- Obtained dismissal of a Consolidated Omnibus Budget Reconciliation Act (COBRA) class action lawsuit on behalf of a large COBRA administrator
- Represented ERISA trustees in connection with multiple Department of Labor investigations into regulatory compliance issues
- Represented ERISA fiduciary in pre-litigation dispute involving propriety of business transaction and related valuation
- Obtained probationary sentence for President of pharmaceutical manufacturer in connection with misbranding prosecution brought by US Department of Justice
- Represented former directors of a large pharmaceutical company in connection with a securities fraud class action alleging that the company engaged in a so-called “channel stuffing” scheme and misrepresented the inventory levels of its pharmaceutical products held at wholesalers
- Represented major supplemental benefits company in connection with defense of trade secret claims brought by competitor
