Tom is a 33-year veteran of the Firm. Tom’s practice focuses on healthcare litigation. He represents major health providers and drug manufacturers in class actions, antitrust cases and qui tam False Claims Act cases involving allegations of violation of federal or state healthcare laws and regulations.

- Co-counsel to the University of New Mexico in a class action in state court asserting alleged misconduct in the University’s pediatric cancer program (Cummings et al. v. Regents of the University of New Mexico)

- Defending a physician management company against a 17200 claim in the US District Court in the Northern District of California alleging a violation of the ban on the corporate practice of medicine (AAEMP v. Envision Health Company)
- Defended a dialysis provider against a class action asserting false off-label marketing a drug in violation of California Business & Professions Code § 17200, filed in the US District Court in Los Angeles (In re Epogen Off-Label Marketing)
- Defended a medical group against an antitrust action filed in the US District Court for the Northern District of California (NorthBay Healthcare v. Kaiser Foundation Health Plan)
- Defended a dialysis provider against an antitrust action filed in the US District Court in Denver (American Renal Associates v. DaVita, Inc.)
- Defended a surgery center company against an antitrust action filed in the US District Court for the Northern District of California (Bay Area Surgical Management v. Aetna, et al.)
- Defended a hospital system against a Qui Tam False Claims Act case filed in the US District Court for the Northern District of California (Lindersmith v. John Muir Health)
- Defended a hospital system against a Qui Tam False Claims Act case filed in the Superior Court in Sacramento County (Martin v. Universal Health Services)
- Counseled a pharmaceutical company in a transfer pricing audit dispute with taxing authority (In Re Roche)
