An eCompliance Solution for Freelancer Assignments

Freelancer Compliance Check is a web-based app for clients in the German labor market. It deploys a questionnaire adapted to a company’s specific circumstances to help identify risks associated with using freelancers.

 

Application

The app is designed to help people with little to no legal knowledge. The user (client) answers questions about a freelancer’s employment details by clicking on predefined options. Each question includes explanations so the client can answer independently, and the tool evaluates risk based on the collected information.

 

Goal

Freelancer Compliance Check supports clients in differentiating between employees and self-employed people. Based on the provided employment details, a client receives a risk report using a traffic light system. Through this automated evaluation, the app allows clients to efficiently resolve possible discrepancies between the contractual arrangement and the freelancer’s actual work . It also makes clients aware of the risks of employment and, if necessary, the need for counseling regarding the contractual arrangement.

 

In Practice

In one representative reference mandate, more than 1,235 audits have been conducted since March 2022 (approximately 80 audits per month).

Financial Times Innovative Lawyers Awards Europe

McDermott was nominated in the “Innovation in Legal Services Product Design” category of the Financial Times Innovative Lawyers Awards Europe 2024. McDermott’s Freelancer Clever Compliance was jointly developed by employment law specialists and the firm’s German legal tech team. The Innovative Lawyers Europe 2024 report, which will be published in September, highlights the law firms and in-house teams that are digitally advanced and use innovative approaches to deliver exceptional value to businesses and society.
