Distressed Real Estate

Overview

By its very name, distressed real estate signals the presence of significant challenges. For savvy real estate companies, investors, lenders and other parties, however, such assets can provide opportunities to strengthen or restructure their portfolios to increase value and better align holdings with organizational goals.

At McDermott, our global distressed real estate team combines the experience of lawyers – drawn from our highly regarded corporate, real estate finance, restructuring, bankruptcy, litigation and tax practices – to provide focused, outcome-driven representation on all aspects of nonperforming loan workouts, restructurings, administration and dispositions.

  • Represented a public mortgage real estate investment trust (REIT) in the highly complex extension and restructuring of a $76 million mortgage loan in connection with a one-million-square-foot mixed-use property in Atlanta, Georgia. The representation required extensive negotiation between the lender and the borrower, including multiple options to extend the loan and an “equity kicker” interest in the property for our client if it sold for more than the debt amount
  • Represented a public mortgage REIT in the sale of two nonperforming loans aggregating more than $100 million, secured by multiple properties in two states.
